These Terms and Conditions ("Terms") govern your use of haydenconcreteandmasonry.com (the "Site") and your engagement with the services provided by Custom Hayden Concrete and Masonry ("we," "us," or "our"), a masonry contractor based in Hayden, ID. By using this Site or engaging us for services, you agree to these Terms.
By accessing this Site, submitting a contact form, requesting an estimate, or entering into a service agreement with us, you confirm that you have read and agree to be bound by these Terms. If you do not agree, please do not use this Site or engage our services.
Custom Hayden Concrete and Masonry provides residential and commercial masonry services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, brick wall installation, stone masonry, and brick pointing.
Services are provided in northern Idaho and eastern Washington. All work is performed by licensed, insured professionals. The scope of any specific project is governed by a written estimate or work order agreed upon by both parties before work begins.
We provide written estimates based on an in-person assessment of the work to be performed. Estimates are valid for 30 days from the date of issue unless otherwise noted. Estimates are not binding contracts - a separate written work order or agreement constitutes the binding service contract.
Pricing may change if site conditions differ materially from those observed at the time of the estimate, if the scope of work expands at your direction, or if unforeseen conditions are discovered during the project. We will notify you of any material change in price before proceeding with additional work.
Prices listed on our website, if any, are for general informational purposes and do not constitute firm quotes. Final pricing is determined by the written estimate following an on-site assessment.
Work is scheduled by mutual agreement. We will make reasonable efforts to complete projects within the estimated timeline. Delays caused by weather, permit processing, material availability, or circumstances beyond our control are not grounds for penalty or damages against us.
You may cancel a scheduled project with at least 48 hours notice at no charge. Cancellations made with less than 48 hours notice, or after materials have been ordered specifically for your project, may result in a cancellation fee equal to actual costs incurred.
We reserve the right to reschedule or cancel work due to unsafe conditions, permit delays, or other circumstances outside our control. In such cases, we will notify you as soon as practicable and reschedule at the earliest mutually available time.
Payment terms are specified in the written work order. A deposit may be required before work begins, particularly for larger projects or projects requiring significant material procurement. The remaining balance is due upon completion of the work unless otherwise agreed in writing.
Accepted payment methods will be stated in your work order. Late payments may be subject to a finance charge of 1.5% per month on the outstanding balance, or the maximum rate permitted by Idaho law, whichever is less.
If collection action is required to recover unpaid amounts, you agree to pay reasonable attorney fees and collection costs in addition to the outstanding balance.
We stand behind our work. Specific warranty terms - including duration and coverage - are stated in your written work order. Where a warranty is provided, it covers defects in workmanship under normal use and conditions.
Warranties do not cover damage caused by factors outside our control, including but not limited to: extreme weather events, flooding, seismic activity, improper maintenance, alterations made by parties other than us, or pre-existing conditions not identified at the time of the estimate.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that information on this Site is complete, accurate, or current. We are not responsible for errors or omissions in Site content.
To the fullest extent permitted by applicable law, Custom Hayden Concrete and Masonry and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a service engagement shall not exceed the amount you paid us for the specific work giving rise to the claim. This limitation applies to all claims, whether based in contract, tort, negligence, or any other theory of liability.
You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not use automated tools to scrape or harvest content from this Site without our written permission.
All content on this Site, including text, images, and the overall design, is the property of Custom Hayden Concrete and Masonry or its licensors. You may not reproduce, distribute, or create derivative works from Site content without our written permission.
We prefer to resolve disputes directly and informally. If you have a concern about a project or billing matter, please contact us first so we have an opportunity to address it.
If a dispute cannot be resolved through direct communication, both parties agree to attempt in good faith to resolve the dispute through non-binding mediation before initiating any formal legal proceedings.
Any dispute that proceeds to formal legal action shall be resolved in a court of competent jurisdiction located in Kootenai County, Idaho. Both parties consent to personal jurisdiction in that venue.
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any legal action arising from these Terms or your use of this Site shall be filed in the state or federal courts located in Kootenai County, Idaho.
We reserve the right to update these Terms at any time. When we make changes, we will update the effective date at the top of this page. Your continued use of this Site or our services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
